Нейтрализация транспортных документов на автомобильном транспорте

В 1956 году в развитии международных грузовых автомобильных перевозок произошло значительное событие – заключение Конвенции о договоре международной перевозки грузов автомобильным транспортом (КДПГ), основной целью которой было унифицировать правила международных перевозок грузов и тем самым способствовать развитию международной торговли. С практической точки зрения это было очень важно для перевозчиков и транспортных компаний. Конвенция описывает главный документ при перевозке грузов – накладную КДПГ.

В последнее время при упоминании накладной КДПГ используется термин «нейтрализация», который рассматривается как вмешательство в систему обращения транспортных документов, цель которого – скрыть фактическое движение груза во время перевозки. При этом нейтрализация накладной не столько противоречит правовым нормам, сколько может привести к нежелательным последствиям для перевозчиков. По этой причине вопрос о том, можно ли нейтрализовать накладную КДПГ в соответствии с действующими правилами и не нарушает ли нейтрализация накладной КДПГ функциональность существующей системы, является актуальным. Поэтому целью настоящей работы является исследование причин и способов нейтрализации накладных КДПГ, а также вариантов обращения с нейтрализованными накладными.

Учитывая, что нейтрализация накладной стала относительно распространённой практикой и означает обмен оригинальными накладными или транспортными документами с другими накладными или транспортными документами, аннулирующий действия первой накладной, в статье авторами на основе собственного исследования выявлены возможности использования нейтрализации накладной КДПГ на практике для определённых видов грузов, маршруты наиболее частого использования, а также риски указанных процедур на автомобильном транспорте.
